Officer Litigation - (210001C)
Description
JOB ROLE/ PURPOSE:
Represent the Organization in Courts of Law and Tax Appeals Tribunal, interpret tax and Case Laws and provide advisory reports and opinions to the Litigation Division and relevant Departments to ensure that URA is ably represented in courts of law and enforcement of tax laws.
PRINCIPAL ACCOUNTABILITIES SPECIFIC ACTIVITIES
1. Represent URA in Courts of Law / Tax Appeals Tribunal in all cases assigned.
a) Review, establish and document the merits/ demerits of cases assigned and seek clarity from the line Manager
b) Appear in court, conduct cases in time and record court proceedings
c) Follow up action on court orders with the respective heads of departments and report back to the line manager
2. Investigate and carry out Legal research on all cases / matters as allocated to inform the legal opinions drafted
a) Discuss, review and analyze with the respective heads of departments to clarify instructions and appreciate the genesis of cases and prepare the legal opinion.
b) Interpret Tax Laws, Case Law & generate legal opinions to support decision-making or action
c) Discuss with relevant stakeholders the key findings and the Legal opinion before handing over the report/ legal opinion to the assignor
d) Generate and submit reports to the respective business heads to appreciate the facts of the case/ matter.
3. Draft pleadings and other documents / reports that arise out of related tax laws, court cases and other transactions for signing off.
a) Draft and review pleadings arising out related tax laws, court cases and other transactions as allocated
b) Discuss with line management the draft pleadings and seek approval before making final copies
c) Review plaintiff’s documents and precedents of similar nature and draft defense to match the context of each case
d) Draft weekly reports and review them with the line Manager for signing off
4. Interview and brief witnesses on Court, Tribunal / Arbitration Proceedings and Practices
a) Meet the line manager under whose jurisdiction a case falls to discuss and agree the material witnesses required in the case.
b) Review the case files and identify / document the information required from the various witnesses to the case under study
c) Meet material witnesses, interview them and record their statements in liaison with an assigned officer from the business area
5. Provide Legal Opinions on the various subjects/areas of interests as requested by clients so as to facilitate rightful decision making
a) Receive and review instructions from the relevant authorities on the subject of legal interpretation and provide the legal interpretation with reference to applicable laws.
b) Prepare and discuss the drafted legal opinion with the assignor to clarify positions and support decision-making/action.


Qualifications
PERSON SPECIFICATIONS
Essential Requirements
a) An honor’s Bachelor Degree in Law from a recognized institution
b) Post Graduate Diploma in Legal Practice
c) Certificate of enrolment as an Advocate of the High Court of Uganda
d) Possession of a valid practicing certificate
KNOWLEDGE
a) Knowledge in court processes
b) Knowledge of Laws and regulations of Uganda and EAC
b) Departmental Instructions and Guidelines, the HRMM, Professional Ethics and the Laws


SPECIAL SKILLS AND ATTRIBUTES
a) Strong Analytical skills
b) High proficiency in the use of computer applications for report writing and research (Knowledge of MS Office required)
c) Knowledge of procurement law
d) Excellent command of the English language - both spoken and written
e) A team player and good negotiator
f) Project management experience and capability
